1. Acceptance of Terms

By accessing and using the better-ed platform (“Service”) operated by Predictive Systems, Inc. (“Company,” “we,” “our,” or “us”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Service.

2. Description of Service

better-ed is an AI-powered voice assessment platform designed for educational use. Our Service includes:

  • Voice recording and analysis tools for student assessments
  • AI-powered evaluation of student responses
  • Performance tracking and reporting features
  • Educational content management and delivery
  • Teacher dashboard and student progress monitoring

AI Transparency & Human Oversight

Some assessments or recommendations are generated via AI. You acknowledge that AI outcomes are intended as decision-support tools. Educators retain final control and may review, override, or adjust any AI-generated result. We will clearly inform users (teachers, students) when AI is used in evaluations, describe its functioning, limitations, and how results should be interpreted.

AI Technology Stack:

  • Google Gemini & OpenAI GPT: Used for AI-powered content generation, conversational assessments, and real-time student interactions
  • LiveKit: Real-time communication infrastructure for audio/video processing
  • better-ed AI: Proprietary AI wrappers for workflow, and prompt management and optimization

3. User Accounts and Registration

To access certain features of our Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information to keep it accurate
  • Maintain the security of your password and account
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

4. Acceptable Use Policy

You agree to use our Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the Service for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the Service or servers connected to the Service
  • Upload, post, or transmit any harmful, offensive, or inappropriate content
  • Violate any applicable laws or regulations
  • Use automated systems to access the Service without permission
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Exploit AI outputs for manipulative marketing, persuasion, profiling, or other non-educational purposes with students
  • Force students to use external AI tools outside of institutional policy or without proper authorization

5. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by Predictive Systems, Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of content you create and upload to the Service, but grant us a license to use, store, and process such content as necessary to provide the Service. Uploaded content may include personal data such as voice recordings, which are subject to our Privacy Policy and applicable data protection regulations.

6. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Service, you consent to the collection and use of information as described in the Privacy Policy.

7. AI Ethics and Fairness

We are committed to responsible AI development and deployment in educational settings:

  • We commit to monitoring our AI models for fairness, reducing algorithmic bias, and ensuring that no discriminatory outcomes arise through use of the platform
  • We maintain documentation on model training, decision logs, and algorithms
  • Upon request by institutions, we support data protection impact assessments and supply audit records
  • We perform regular algorithmic audits and maintain transparency in our AI decision-making processes
  • We may provide training materials or documentation to assist educators and students in understanding AI behavior, limits, and responsible use

8. Educational Use and Student Data

Our Service is designed for educational purposes. When using our Service with students:

  • You are responsible for obtaining necessary parental consent for students under 13
  • You must comply with applicable educational privacy laws (FERPA, COPPA, GDPR-K, etc.)
  • Student data should only be used for legitimate educational purposes
  • You must protect student privacy and maintain confidentiality
  • You are responsible for ensuring appropriate supervision of student use
  • AI assessments are advisory tools; final evaluation decisions rest with educators, who may review, override or adjust AI-generated results
  • If a school or institution has not approved this Service for student use, teachers should not require individual students to use it outside institutional policy

9. Service Availability and Modifications

We strive to maintain high service availability but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We shall not be liable for any modification, suspension, or discontinuance of the Service.

10. Limitation of Liability

To the maximum extent permitted by law, Predictive Systems, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

11. Disclaimers

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

12. Indemnification

You agree to defend, indemnify, and hold harmless Predictive Systems, Inc. and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your use of the Service or violation of these Terms.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will cease immediately.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Philippines, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the “Last updated” date. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
